File Your Trademark Using an Attorney

Many business owners, small and large, do not own Federal trademarks for their brand. This can leave them open to many potential issues, including disputes with other users, difficulty in preventing others from using your brand name, lack of ability to register with Amazon.com, and more.

What Should I File?

There are a few key differences between logo marks and word marks, so familiarize yourself with them both to find out what works best for you and your business.

Logomark

A logomark is a graphic or graphic/text combination that represents a brand. Examples include the Nike Swoosh or the Apple logo with the bite.
  • Consists of an image and its colors
  • A symbolic representation of a brand
  • Must be unique
  • Can include words

Wordmark

A wordmark is just text. In other words, it is not limited by colors, fonts, graphics, etc. If you want to ensure someone else can't use your name, this is the mark to choose.
  • Text-only
  • Consists of one word or a short phrase
  • Must be unique and not too generalized
