What Type of Trademark Do I Need?

Different businesses have different needs and uses for their logos and branding. If you are looking to protect your company or product name, then a "word" mark is appropriate. If you have a graphic you'd like to protect, then choose a "logo" mark. Want to protect a name and a logo? Choose the "logo" application and submit your name and logo combination.

LogoMarks

A logomark is a graphic or graphic/text combination that represents a brand. Examples include the Nike Swoosh or the Apple logo with the bite.

  • Consists of an image and its colors
  • A symbolic representation of a brand
  • Must be unique
  • Can include words

WordMarks

A wordmark is just text. In other words, it is not limited by colors, fonts, graphics, etc. If you want to ensure someone else can't use your name, this is the mark to choose

  • Text-only
  • Consists of one word or a short phrase
  • Must be unique and not too generalized

FAQ

1Will a licensed attorney file my trademark?
Yes. Each trademark application submitted through this site is reviewed and filed by an Attorney with the United States Patent & Trademark Office.
2How long will it take?
We will review and file your trademark within one business day. However, the government process can be lengthy, with the average trademark being registered 9-12 months after the application has been submitted. We will keep you informed during this process.
3What is the difference between TM and ®?
The TM symbol can be used at any time and signifies a common-law trademark. If you aren’t using it yet, you should begin using it. The ® symbol is reserved for registered trademarks. We will let you know when your trademark registers and when you can begin using that symbol.
4Can I contact you for updates?
Yes, you can contact us by phone (435-634-8889) or by email ([email protected]) anytime!
1What is the cost of the application? Does it include the government fee?
The total cost of the application is $800. This fee includes both the attorney fee and the government fee (for one class). If additional government fees would be required, the attorney will contact you to discuss before filing.
2Are there any other costs?
It depends. If you are currently using the trademark, and the government approves your initial application, then no additional fees would come due. You would receive your trademark certificate for a total cost of $800. If you are not yet using the trademark, then additional fees will come due about 6 months after filing (or later). These fees ($350) include govt. fees and attorney fees for submitting proof of use to the trademark office. If you are not using the mark when finally approved by the govt., you can pay for 6-month extensions ($350).
3Will I receive a confirmation when it has been filed with the United States Patent & Trademark Office?
Yes. Our paralegal will send you a confirmation email once your trademark application has been filed.
